Seeing as it mentions "illegal" assume that lynching is a mandatory criminal sentence. Lynching would likely be considered cruel and unusual punishment, and therefore unconstitutional. Downside invalid.

If it were racism by european definition it would be ok. As long as you do not descriminate because of it it is ok to say "that black dude over there". Not sure how that would end in the US though...
